1Introduction

1.1These terms of use (the “Terms”) govern your access to and use of the Cortile website, mobile application and platform (together, the “Services”).

1.2By accessing or using the Services, you agree to be bound by these Terms. If you do not accept these Terms, you must not use the Services.

The Services are provided by Project Ark Limited, trading as Cortile (“Cortile”, “we”, “us” or “our”), a company registered in England and Wales under company number 12236613, whose registered office is at Pannone Corporate LLP, 378–380 Deansgate, Manchester M3 4LY. 3Use of the Services

3.1You must be at least 18 years of age to use the Services. Residents are granted access to the Services by their landlord or managing agent.

3.2You are responsible for keeping your login details confidential and for all activity that occurs under your account.

3.3Business customers use the Services under a separate written agreement with us. In the event of any conflict between that agreement and these Terms, that agreement shall prevail.

3.4Payments made through the Services are processed by Stripe under its own agreement with the relevant landlord or managing agent. Any query regarding amounts payable should be directed to your landlord or managing agent.

3.5You retain ownership of any content you upload to the Services. You grant us a non-exclusive, royalty-free licence to store and display that content to the extent necessary to provide the Services.

4Intellectual property

4.1We or our licensors own all intellectual property rights in the Services, including their software, content, design and branding.

4.2You may view the Services, print or download pages for your personal use, and link to our website.

4.3You must not copy, modify or republish any material from the Services, extract data from the Services by automated means, reverse-engineer the Services, or create any work derived from them.

5Cookies

Our use of cookies is described in our Privacy Policy.

6Warranty

6.1While we take reasonable steps to keep the Services accurate and available, we do not warrant that the Services will be complete, error-free or uninterrupted.

6.2We may modify, suspend or withdraw any part of the Services at any time without notice.

7Breach of these Terms

If you breach these Terms, we may issue a warning, suspend or terminate your access to the Services, or take legal action against you.

8Limitation of liability

8.1To the fullest extent permitted by law, we shall not be liable for any loss arising from your use of the Services, from any inaccuracy or omission in them, or from the acts or omissions of landlords, managing agents or other third parties.

8.2Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.

8.3If you are a consumer, nothing in these Terms affects your statutory rights.

9Third-party websites

The Services may contain links to third-party websites. We have no control over, and accept no responsibility for, the content of those websites.

10Changes, governing law and jurisdiction

10.1We may amend these Terms from time to time and will notify you of any material changes.

10.2These Terms are governed by the law of England and Wales, and the courts of England and Wales shall have jurisdiction over any dispute arising from them.

10.3If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in the courts of your country of residence.
